How foreclosure works in New York

New York foreclosures go through court.

Main steps and notices
  • For an owner-occupied home of up to four units, the lender sends a notice at least 90 days before filing suit.
  • The court holds a settlement conference within 60 days after proof of service is filed.
  • Outside a city or village, the sale is posted in three public places at least 28 days ahead, and it's published in a county newspaper.
Catching up before the sale
Reinstating before judgment ends the case. After judgment and before the sale, it pauses the case.
After the sale
There is no right to redeem after the sale.
Before any of this starts
Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
Governing law
New York RPAPL § 231, § 1301 et seq.; CPLR 3408
