How foreclosure works in Alaska
Most Alaska foreclosures are non-judicial, run by a trustee.
- Main steps and notices
- The trustee records a notice of default at least 30 days after the default and at least 90 days before the sale, and the borrower gets a copy by certified mail within 10 days.
- The sale notice is posted in three public places within five miles of the sale at least 30 days ahead.
- It also runs in the newspaper once a week for four weeks and online, starting at least 45 days before the sale.
- Catching up before the sale
- The borrower can reinstate any time before the sale, but the trustee can refuse after two earlier notices of default that were each cured.
- After the sale
- There is no right to redeem after a non-judicial sale unless the deed of trust grants one.
- Before any of this starts
- Under federal rules, a mortgage servicer generally can't make the first notice or filing for foreclosure until the borrower is more than 120 days behind.
- Governing law
- Alaska Statutes § 09.35.140; § 34.20.070 et seq.
